Terms of Service - Studio D19 Works™

 

Welcome to the official website of Studio D19 Works™ ("Studio D19", "we", "our", or "us"). These Terms and Conditions (“Terms”) govern your access to and use of our website and the purchase of our products, including collectible figurines inspired by the rich heritage of ancient India. By accessing or using this website, you agree to be legally bound by the following Terms. You must be at least 18 years of age to use this Site.

 

Article 1 – Purpose

These Terms set forth the rights, obligations, and responsibilities of Studio D19 Works™ and users of the website ("User(s)") in connection with the use of internet-based services offered through our website (the “Site”) operated and managed by Studio D19 Works™ for e-commerce purposes.
 

These Terms shall apply equally to services accessed via desktop, mobile devices, or other digital communication platforms, unless the context indicates otherwise.

 

Article 2 – Definitions

  1. Site refers to the virtual commercial platform maintained by Studio D19 through which goods and services are offered to Users.

  2. User means any individual, whether registered or unregistered, who accesses or uses the services provided by Studio D19 via the Site.

  3. Member refers to a User who has completed the membership registration process by submitting personal information and thereby receives regular updates and services.

  4. Non-Member refers to any User who utilizes the services without registering as a Member.

 

Article 3 – Product Orders and Purchase Agreement

  • Members may order products offered on the Site in accordance with the procedures established by Studio D19.

  • A binding purchase agreement shall be formed upon dispatch of a shipping confirmation email to the Member’s registered email address.

  • Studio D19 reserves the right to accept or reject any order for any reason.

  • In the event of pricing discrepancies or typographical errors, Studio D19 will notify the User and seek confirmation before processing the order.

  • Studio D19 reserves the right to cancel orders or take appropriate action in cases of fraudulent activity, policy violations, or misuse of the Site.

  • Pre-order shipping fees are estimates and subject to revision due to changes in packaging, carrier rates, or product specifications.

  • In case of high-value orders, Studio D19 may reach out to the customer for further confirmation.

  • Studio D19 shall not be held liable for any damages, losses, or inconvenience arising from a User’s failure to receive a purchase confirmation or approval—whether due to internet connectivity issues, system errors, or other circumstances beyond the reasonable control of Studio D19.

  • All shipping fees quoted for pre-order items are indicative and subject to revision. Such estimates are based on prototype models and may be adjusted following final production. Studio D19 reserves the right to amend the shipping charges in the event of changes in courier tariffs, product weight, packaging dimensions, or any other logistical factor as may be reasonably necessary.

  • Reward System: Users shall receive reward points worth 5% of the retail price upon shipment of the Order. Users shall also have the right to redeem such reward points for subsequent purchases in future. These points do not expire.

 

Article 4 – Payments

  • Prices shown include applicable consumer taxes.

  • Accepted payment methods include PayPal and other methods specified on the Site.

  • Users choosing instalment plans must complete all payments before shipment of the Order. For reservations, the deposit will be deducted from the total price; failure to complete payment invalidates the order.

  • For reserved goods, the reservation deposit will be settled as a part of the price when the reservation order is for Studio D19 processed by Studio D19. If any reservation deposit may not be settled, the relevant reservation order will become invalid. Studio D19will charge the Member the balance of the price of the goods (including consumption tax and delivery fee) at or around the shipment of the goods.

  • For in-stock goods, if You wish to cancel before the final payment is completed, when you ordered items by monthly payment, Studio D19 shall charge Non-Refundable Deposit (“NRD”) as a cancellation fee. Studio D19 will refund the amount upon deducting NRD.

  • Users must agree to PayPal’s billing policies if using PayPal. Studio D19 is not liable for disputes arising between Users and third-party payment processors.

 

Article 5 – Delivery

  • Orders are shipped via designated carriers (e.g., FedEx, DHL, UPS).

  • Studio D19 shall not be liable for delivery failures resulting from incorrect User information or delays caused by carriers.

  • Estimated shipping dates are subject to change. Orders may be cancelled in the event of stock unavailability or cancellation of a product line.

  • Shipping is restricted to specific territories. Orders may not be redirected to unapproved regions or countries once the Order has been placed.

  • Studio D19 shall provide an invoice to the Member for remainder of payment, upon shipment of the Order. In case there are any default in payment from 30 days upon initiating the invoice, the Order shall be automatically cancelled. Subsequently, the total payment, minus NRD, will be refunded to the User and next Member on the waiting list shall have the right to make the purchase.

 

Article 6 – Product Warranty, Return, Exchange, Deposit and Refund Policy

Product Warranty

All products listed for sale on the Site are covered under a limited warranty provided by the original manufacturer, licensor, or distributor. This warranty safeguards against defects in materials or workmanship for a period of thirty (30) calendar days from the date of purchase order or transaction completion, whichever is applicable. Should a product exhibit any such defect within this period, the purchaser may notify Studio D19 at contact@d-19.com, and Studio D19 will facilitate a resolution, which may include the correction, repair, or replacement of the defective product. Where such remediation is not feasible, Studio D19 may assist in processing a refund, subject to applicable conditions.

Studio D19 assumes no liability for goods or services procured via third-party websites, even where such websites were accessed through links or referrals from the Site. Furthermore, Studio D19 bears no responsibility for resolving product-related issues where: (i) the notification of defect is received after the lapse of the 30-day warranty period; or (ii) the products were not purchased directly via the Site.
 

Deposit and Non-Refundable Deposit (NRD) Terms

Unless otherwise specified, a deposit equal to thirty percent (30%) of the product's retail price shall be payable to confirm any pre-order. Of this amount, twenty percent (20%) of the full retail price shall be deemed as NRD and shall be considered a cancellation fee. Payment of the deposit indicates the buyer’s acceptance of these terms and confirms the order.

Customers may cancel their order within twenty-four (24) hours of placement without incurring any charges. In such cases, the NRD shall be refunded in full within one to two (1–2) business days. Please allow five to seven (5–7) business days for the refund to be reflected in the original mode of payment.

Once the 24-hour grace period has elapsed, the NRD becomes strictly non-refundable. The following conditions shall apply:

  • NRDs are non-transferable and cannot be credited towards other orders.

  • NRDs cannot be reinstated or reapplied to alternate purchases.

  • Refunds of NRDs may be considered only in exceptional circumstances, such as when the product’s delivery is delayed by more than ninety (90) days from the originally estimated arrival date. In such cases, customers must submit a written request to Studio D19 seeking cancellation and NRD refund.

Deposits not including an NRD component will be refunded in full only if the cancellation is made within the aforementioned 24-hour window.
 

Refunds and Exchange Conditions

Where a refund is to be issued, the following conditions shall apply:

  • Studio D19 does not compensate for differences arising from foreign exchange rate fluctuations between the time of payment and refund.

  • Bank fees, currency conversion charges, and related financial costs incurred by the customer are not reimbursable by Studio D19.

  • Return shipping costs shall be borne solely by the customer. If a refund is approved, any applicable return shipping charges shall be deducted from the refund amount.

  • Upon issuance of the final payment request by Studio D19, the total deposit paid shall be forfeited as a cancellation fee if the order is cancelled thereafter.
     

Return and Exchange Eligibility

Products delivered in good condition may only be returned or exchanged due to defect or malfunction that exists at the time of delivery. Such defects must be reported to Studio D19 at contact@d-19.com within thirty (30) days of receipt by the purchaser or designated recipient (“Addressee of the Goods”). Whether a defect exists shall be determined solely at Studio D19’s discretion.

Returns due to personal reasons unrelated to product defects are permissible only with the customer bearing all round-trip shipping costs and any associated damage fees.
 

Returns or exchanges will not be permitted under the following circumstances:

  • More than 30 days have passed since the product’s delivery;

  • No return/exchange request was submitted within the 30-day period;

  • The item was not purchased directly from Studio D19;

  • The request is submitted by someone other than the original purchaser or designated recipient;

  • Return is initiated from a country or region other than the original delivery destination;

  • The purchaser’s membership has been cancelled;

  • The product was damaged, soiled, or altered by the customer post-delivery;

  • Packaging was damaged during return transit;

  • Studio D19 determines there are no qualifying defects;

  • Any other condition Studio D19 deems ineligible.
     

Return Process

Customers must email Studio D19 at contact@d-19.com stating the order number, product details, and serial number to initiate a return or exchange. Studio D19 will inspect the reported issue and respond with an approval or denial. No return or exchange shall proceed without such written confirmation.

In certain cases, where substitute goods are unavailable, Studio D19 may issue a refund rather than offer an exchange.

Products must be returned in their original packaging, including the product’s "Art Box" and outer carton. Damage to packaging materials will render the item non-returnable. Returned goods must arrive in the same condition as initially delivered. If improper packaging or customer negligence results in damage to the returned item, Studio D19 reserves the right to charge repair or restoration costs to the customer.

 

Product Unboxing and Claims Policy
In the event of a claim related to damaged or defective products received, it is mandatory that the customer provides a clear, uninterrupted video recording of the unboxing process from the moment the package is opened. This video shall serve as primary evidence for assessment of such claims. Studio D19 reserves the right to accept or deny any damage-related claims in the absence of this video documentation.
 

Article 7 – Customs and Export Regulations

  • Import duties, value added taxes, and Customer fees are the sole responsibility of the User or recipient. Studio D19 shall not be liable for any associated costs or delays due to customs procedures. The carrier shall directly charge any duties, taxes and fees due to be paid by the Customer.

  • In the event of refused delivery due to unpaid customs duties, Studio D19 may deduct the cost of shipping and return from any applicable refund. In addition, Studio D19 shall not be responsible for any delays caused due to custom troubles and customs procedures.

  • Studio D19 will not provide falsified documentation, or export certificates such as export visa and complies with all legal requirements regarding declarations and invoicing.

 

Article 8 – Intellectual Property

  • All intellectual property rights including but not limited to copyrights with regards to content, imagery, and figurine designs shall solely vests with Studio D19 and are protected under applicable laws.

  • Users are advised not to reproduce, redistribute, publish, or commercially exploit any content, imagery, and figurine designs produced by Studio D19 without prior written consent from Studio D19, otherwise appropriate legal action shall be taken against such infringement.

  • In case Studio D19 determines to use any User-owned content, Studio D19 will obtain express permission from such User in advance.

  • The Certificate of Authenticity accompanying each product is intended solely for verification purposes and must not be copied, scanned, reproduced, or distributed, whether in digital or physical form. Any such unauthorized duplication shall be deemed a violation of intellectual property and may result in appropriate legal action.

 

 

Article 9 – Dispute Resolution

  • Studio D19 encourages Users to share feedback and grievances and has established a process for resolution of such matters.

  • Studio D19 will make reasonable efforts to address and resolve User complaints promptly. If immediate resolution is not possible, Users will be notified of expected timelines.

  • Disputes may be resolved through consumer mediation mechanisms including the Fair-Trade Commission, local municipal authorities, or arbitration procedures as applicable.

 

Article 10 – Governing Law and Jurisdiction

  • All legal matters relating to e-commerce transactions with Studio D19 shall be governed by the laws of the Republic of India.

  • In case of disputes, the competent court shall be determined based on the User’s address or, if unavailable, the relevant provisions of the Indian Civil Procedure Code shall apply.

  • For international Users, jurisdiction will be determined as per applicable cross-border regulations and procedures.

Shipping Policy

  • Orders are not shipped or delivered on weekends or holidays. If we are experiencing a high volume of orders, shipments may be delayed by a few days. 
  • Please allow additional days in transit for delivery. If there will be a significant delay in the shipment of your order, we will contact you via email or phone.
